Your order is an offer to Barigelli truffles to buy the product(s) in your order. When you place an order to purchase a product from Barigelli truffles, we will send you an e-mail confirming receipt of your order and containing the details of your order (the “Order Confirmation E-mail”). The Order Confirmation E-mail is acknowledgement that we have received your order, and does not confirm acceptance of your offer to buy the product(s) ordered. We only accept your offer, and conclude the contract of sale for a product ordered by you, when we dispatch the product to you and send e-mail confirmation to you that we’ve dispatched the product to you (the “Dispatch Confirmation E-mail”). If your order is dispatched in more than one package, you may receive a separate Dispatch Confirmation E-mail for each package, and each Dispatch Confirmation E-mail and corresponding dispatch will conclude a separate contract of sale between us for the product(s) specified in that Dispatch Confirmation E-mail. Your contract is with Barigelli limited. Without affecting your right of cancellation, you can cancel your order for a product at no cost any time before we send the Dispatch Confirmation E-mail relating to that product. This right to cancel does not apply to certain categories of products, for example the fresh truffle if it has been already ordered for your order.
You consent to receive sales invoices electronically. Electronic invoices will be made available in pdf format in the Your Account area of the web site. For each delivery, we will inform you in our Dispatch Confirmation E-mail if an electronic invoice is available.
All products (not chilled) from the Barigelli truffles sites can be returned within 5 days of receipt of the products to Barigelli truffles if the products are complete and are sealled and undamaged condition.
If you return products according to this voluntary returns guarantee, we will refund to you the purchase price already paid by you, but not the delivery costs of your initial purchase. Likewise the transport risk and return costs might be borne by you
Unless one of the exceptions listed above applies, you can cancel your order within 5 days from the day on which you or a third party indicated by you (other than the carrier) receives the goods purchased or from the day of the conclusion of the contract.
You must inform us of your decision to cancel your order. You may submit your request by email to firstname.lastname@example.org.
To meet the cancellation deadline, it is sufficient for you to send your communication before the 5 days’ cancellation period has expired and return the item to us in 3 working days.
2.1 EXCEPTIONS TO THE RIGHT OF CANCELLATION
The right of cancellation does not apply to: products which are not suitable for return due to health protection or hygiene reasons if unsealled by you after delivery; fresh and chilled food ordered from us for your order or already shipped; once a shipping label has been created, the goods are considered to have been shipped, if it is not refrigerated food and you wish to cancel the order, once the package has been received it must therefore be sent back.
2.2 EFFECTS OF CANCELLATION
We will reimburse all payments received from you for the goods purchased, no later than 15 days from the day on which we received the items. We will use the same means of payment as you used for the initial transaction. In any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back. If reimbursement occurs after the maximum time period mentioned above, the amount due to you will as of right be increased.
Note that you must send back the goods no later than 5 days from the day on which us you communicate your cancellation. You will have to bear the direct cost of returning these goods.
2.3 CANCELLATION BY US
We reserve the right to cancel the contract between us if: we have insufficient stock to deliver at least half of the goods you have ordered; we do not deliver to your area; or one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 10 days of your order if you do not wish place an alternative order or the same order when available again. We will not be obliged to offer any additional compensation for disappointment suffered.
3. COMPLAINTS AND LIABILITY
If you notify a complaint or problem with a order to us, we will do as much as possible to resolve the problem and will therefore be at your choise for: to replace products that are damaged, unless that would be impossible and anyway the same amount; reduce the purchase price for the next order to an appropriate amount if incorrect quantity or increase the quantity shipped, or other items, in the following order to reach the same value as the incorrect quantity of the previous order (if not out of stock); to refund to you the amount paid by you for the goods in question; to fill any shortages or non-deliveries if you contact us no later than 5 days from when you received the order.
If the goods we deliver are not what you ordered or are damaged or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in 5 days from when you receive the products, at the contact details listed on our website.
If you do not receive goods ordered by you within 10 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our address of the problem within 10 days of the date on which you ordered the goods.
All notices from you to us must be in writing and sent by email.
All notices from us to you will be sent to you at the email address you provide in your order form.
5. EVENTS BEYOND OUR CONTROL
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, natural disaster, fire, explosion or accident, pandemic and any problem with delivery company
We will deliver the goods ordered by you to the UK, EU or outside EU address you give us for delivery at the time you make your order (address cannot be changed).
When ordering products from Barigelli truffles for delivery outside of mainland UK you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information.
If you have specified a delivery address with your order which is outside the UK or the EU you must observe and comply with all applicable regulations and legislation. Please note, however, that some products can be shipped from Italy so there is a possibility to pay less for duties and customs for EU market and extra EU, send us a message for more informations. Delivery will be made as soon as possible after your order is accepted and in any event within 10 days of your order. You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or damage.
7. ALTERATIONS TO SERVICE OR AMENDMENTS TO THE CONDITIONS OF USE
We reserve the right to make changes to any policies, terms and conditions including these Conditions of Use, and Service Terms at any time. You will be subject to the terms and conditions, policies and Conditions of Use in force at the time that you use the services. If any of these Conditions of Use is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
8. YOUR ACCOUNT
You may need your own Barigelli truffles account to use certain services, and you may be required to be logged into the account and have a valid payment method associated with it.
If you use Barigelli truffles site you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and to the extent permitted by applicable law you agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should be changed immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorised manner. You are responsible for ensuring that the details you provide us with are correct and complete, and for informing us of any changes to the information you have provided. 9. PRICING AND AVAILABILITY
We list availability information for products sold by us on the website including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. As we process your order, we will inform you by e-mail as soon as possible if any products you order turn out to be unavailable and you will not be charged for those products.
Please note that unless otherwise stated on the website, delivery estimates are just that. They are not guaranteed delivery times and should not be relied upon as such.
If any part of these terms and conditions is unenforceable, the enforceability of any other part of these conditions will not be affected.
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
